TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that she has made an Order under Section 247 of the above Act entitled "The Stopping up of Highways (North East) (No.5) Order 2012" authorising the stopping up of an irregular shaped area of highway commencing from the southern boundary of No 15 Saint Margaret’s Avenue and extending south westerly for a maximum distance of 53 metres and having a maximum width of 14 metres and an irregular shaped area of highway commencing 20 metres north westerly from the north western corner of No. 1 St Margaret’s Avenue and extending south westerly for a maximum distance of 17 metres and having a maximum width of 8 metres at Sunderland, in the City of Sunderland to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Groundwork North East by Sunderland City Council on 5 August 2011 under reference 11/01830/SUB

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, 2nd Floor, Lancaster House, Hampshire Court, Newcastle Business Park, Newcastle upon Tyne, NE4 7YH (quoting reference NATTRAN/NE/S247/407) and may be inspected at all reasonable hours at Customer Services Centre, 31-32 Fawcett Street, Sunderland, SR1 1RE.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 2 February 2012 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

THE SCHEDULE

Planning permission is granted for the change of use of hardstanding, provision of lockable bollards, stopping up of highway and removal of 2 no. detached garages/sheds to provide a scheme of landscaping (AMENDED DESCRIPTION) at Land At Saint Margarets Avenue Sunderland.
